1. Seller identification

CAMA SRL
Avenue Emile Digneffe 25, 4000 Liège, Belgium
Company / VAT number: BE 1026.683.137
Email: shop@cama.beer
Website: www.cama.beer

2. Scope

These general terms and conditions of sale (terms) apply to every order placed by a consumer on the webshop www.cama.beer. Every order implies unreserved acceptance of these terms, to the exclusion of any other conditions. CAMA reserves the right to change these terms at any time; the applicable terms are those in force at the time of the order.

3. Products

CAMA sells alcohol-free craft beers (alcohol content below 0.5% vol.), certified organic (BE-BIO-02). Product photographs and descriptions are as accurate as possible but are not contractually binding as to visual nuances (colour, foam, label). Products are offered while stocks last.

4. Prices

Prices are shown in euros, all taxes included (VAT incl.), excluding delivery costs. Delivery costs are shown before the final confirmation of the order. CAMA may change its prices at any time, but products are invoiced at the price in force when the order is confirmed.

5. Order and conclusion of the contract

An order is placed in the following steps: selection of the products, review of the cart, entry of contact details and delivery address, choice of payment method, final confirmation with an obligation to pay. The contract is concluded when the order confirmation is sent by email. CAMA reserves the right to refuse or cancel an order in the event of a payment dispute, a manifestly incorrect address or suspected fraud.

6. Payment

Payment is made online, securely, through the methods offered at checkout (including Bancontact and credit/debit cards). The order is only shipped once payment has been received in full.

7. Delivery

Delivery terms (areas, times, costs, transfer of risk, procedure for damaged parcels) are set out in the shipping policy, which forms an integral part of these terms.

8. Right of withdrawal

In accordance with Book VI of the Belgian Code of Economic Law, consumers have 14 calendar days from receipt of the products to exercise their right of withdrawal, without giving a reason and without penalty.

  • Withdrawal is notified by an unequivocal written statement (email) before the deadline expires.
  • Products must be returned unopened, with the cap or cork intact, in their original packaging, within 14 days of notification. Unsealed products are not taken back, for reasons of health protection and hygiene (art. VI.53, 5° CEL).
  • Return costs are borne by the consumer.
  • The refund (price of the products + initial standard delivery costs) is made within 14 days of the withdrawal notification. CAMA may withhold the refund until it has received the goods or proof of shipment. The refund is made using the same payment method as the order.

9. Legal guarantee of conformity

Products are covered by the two-year legal guarantee of conformity (art. 1649bis and following of the former Belgian Civil Code). Given the nature of the products (foodstuffs with a best-before date), the guarantee applies within the limits of the best-before date shown on each product. Any lack of conformity must be reported to CAMA within a reasonable time after it is noticed.

10. Liability

CAMA's liability is limited to the amount of the order concerned. CAMA is not liable for indirect damage or for cases of force majeure (including strikes, transport incidents, supply shortages). Nothing in these terms limits CAMA's liability in the event of fraud, gross negligence or bodily injury.

11. Personal data

Personal data collected when ordering is processed in accordance with the GDPR, solely for managing orders, delivery, invoicing and, with consent, marketing communication. Details are given in the site's privacy policy. Consumers have the rights of access, rectification, erasure and objection, by writing to the contact address above.

12. Intellectual property

All elements of the site (trademarks, logos, texts, visuals, photographs) are protected by the intellectual property rights of CAMA SRL (trademark registered with the EUIPO, classes 32 and 33). Any reproduction without prior written permission is prohibited.

13. Applicable law and disputes

These terms are governed by Belgian law. In the event of a dispute, an amicable solution is sought first. Consumers may contact the Consumer Mediation Service (North Gate II, Boulevard du Roi Albert II 8 box 1, 1000 Brussels, mediationconsommateur.be). Failing that, the courts of the judicial district of Liège have jurisdiction, without prejudice to mandatory rules of jurisdiction in favour of the consumer.
